Terms of Service

The rules of the road

By using Flixio, you agree to these terms. Please read them — they protect both you and us, and they explain how copyright complaints are handled.

1. Acceptance of terms

These Terms of Service ("Terms") govern your use of Flixio (the "Service"), operated at flixio.app and all its language subdomains. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The service

Flixio is a search engine and index for free, publicly available video content hosted on third-party platforms (primarily YouTube). We do not host, upload, transcode, store, or modify any video. We do not sell anything, and there is no paid tier.

No availability guarantee. Titles may be removed from the source platform at any time. If a video becomes unavailable on YouTube, it will disappear from Flixio. We do not guarantee uninterrupted access, specific titles remaining available, or the accuracy of metadata.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use Flixio. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you further represent that you have authority to bind that organization to these Terms.

4. Acceptable use

You agree not to:

  • Use Flixio for any unlawful purpose or in violation of any applicable local, state, national, or international law
  • Scrape, crawl, or otherwise automatically harvest content from the Service at a rate that exceeds normal human browsing, or bypass any rate-limiting or anti-bot measures we have in place
  • Attempt to probe, scan, or test the vulnerability of the Service or to breach any security or authentication measure
  • Circumvent, disable, or otherwise interfere with security-related features of the Service
  • Republish, mirror, or frame the Service (or any substantial portion of it) without our prior written consent
  • Use the Service to harass, abuse, defame, or harm any other person, or to send unsolicited communications
  • Upload, post, or transmit through any user-content feature (e.g. comments) anything that is unlawful, infringing, obscene, hateful, or otherwise objectionable
  • Impersonate Flixio, a Flixio employee, or any other person or entity
  • Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure

We reserve the right to block IP addresses, networks, or user-agents that violate this section, without prior notice.

5. Intellectual property

The Flixio brand, logo, design, source code, and original written content are owned by Flixio and protected by copyright and trademark law.

All video content indexed on Flixio is the property of its respective uploader and rights holder. Flixio does not claim ownership of any third-party video. Titles, posters, and trademarks are used editorially (nominative fair use) to identify and locate the works — not to suggest any sponsorship or endorsement by the rights holder.

6. Copyright complaints (DMCA & equivalent laws)

Flixio respects intellectual property rights and complies with applicable copyright laws, including the U.S. Digital Millennium Copyright Act ("DMCA") and the EU Copyright Directive.

6.1 How to file a takedown notice

If you believe that a title indexed on Flixio infringes your copyright, send a written notice to our designated contact that includes all of the following:

  1. A physical or electronic signature of the rights holder, or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works)
  3. Identification of the allegedly infringing material with enough information for us to locate it — preferably the Flixio URL (flixio.app/watch/{id}/{slug}/) and/or the underlying YouTube URL
  4. Your contact information: name, address, telephone number, and email address
  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury (for U.S. notices) or equivalent legal sanction in your jurisdiction, that the above information in your notice is accurate and that you are the rights holder, or authorized to act on the rights holder's behalf

6.2 Where to send it

6.3 What happens after you file

  1. We acknowledge receipt within 3 business days.
  2. If the notice is substantively complete and on its face valid, we remove or disable access to the indexed title within 5 business days of receipt.
  3. Where the source video is hosted by YouTube, we additionally forward your notice (or its substance) to YouTube via their own copyright report form, since they are the actual host.
  4. If the notice is incomplete or insufficient, we will reply requesting the missing information before taking action.

6.4 Counter-notice

If you believe content removed under this procedure was the result of a mistake or misidentification, you may submit a counter-notice containing: your physical/electronic signature, identification of the removed material and its prior location on Flixio, a statement under penalty of perjury that you have a good-faith belief the material was removed in error, your name, address, telephone, and a consent to the jurisdiction of your local federal court (or, if outside the U.S., any judicial district in which Flixio may be found). Send to the same email above with the subject line "DMCA Counter-Notice".

6.5 Repeat infringers

Flixio does not host user uploads, so the standard "repeat infringer" policy applies to indexed source videos: we delist any title that has been the subject of two or more substantively valid takedown notices.

6.6 Good-faith misrepresentation

Be aware that under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages. Submit only notices you genuinely believe are accurate.

7. User content (comments)

Some pages allow you to post comments. You retain ownership of what you write but grant Flixio a worldwide, non-exclusive, royalty-free license to display, store, and reproduce that content for the purpose of operating the Service. You represent that you have the right to post anything you submit and that it does not violate any law or anyone's rights.

We may remove user content at any time, for any reason, including (but not limited to) content that is unlawful, infringing, hateful, threatening, defamatory, obscene, or spam.

8. Third-party services

The Service embeds content from and links to third-party platforms. These include, primarily, YouTube (operated by Google Ireland Ltd.). Your interactions with these third parties are governed by their own terms and privacy policies, not these Terms. Flixio is not responsible for:

  • The availability, accuracy, or legality of third-party content
  • Advertising shown by third-party platforms on or around their players
  • Any data these third parties collect when you interact with their embedded content
  • Changes a third party makes to its terms, player, or content

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

FLIXIO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.

FLIXIO DOES NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR THE ACCURACY, LEGALITY, OR APPROPRIATENESS OF ANY THIRD-PARTY CONTENT INDEXED ON THE SERVICE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FLIXIO, ITS OPERATORS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on or through the Service
  • Unauthorized access, use, or alteration of your transmissions or content

IN ANY CASE, FLIXIO'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED US DOLLARS (US$100) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.

Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable law (including death, personal injury, fraud, or fraudulent misrepresentation).

11. Indemnification

You agree to defend, indemnify, and hold harmless Flixio and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of and access to the Service
  • Your violation of any of these Terms
  • Your violation of any third-party right, including any copyright, property, or privacy right
  • Any claim that your user content caused damage to a third party

12. Changes to these terms

We may revise these Terms from time to time. The "Last updated" date below will reflect the change. If the changes are material, we will display a notice on the homepage for at least 14 days. Your continued use of Flixio after a change constitutes acceptance of the new Terms.

13. Governing law & jurisdiction

These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the country in which Flixio's operating entity is established, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, except where mandatory consumer-protection laws of your country of residence provide otherwise.

Nothing in this section removes your right to bring proceedings in your local courts for claims you have against us.
